Palantir Technologies (PLTR) — threat to the moat

The ruling Palantir won opened defence procurement to every commercial software vendor, not only to Palantir.

The court ruling Palantir won requires the government to consider commercially available products1. It does not require the government to buy Palantir's. Any software company that can offer a product off the shelf benefits from the same rule.

No sign yet that rivals are using the opening.

That is the limit of a legal advantage. It removed a barrier in front of Palantir, and it removed the same barrier in front of every rival that sells software as a product. Palantir's 10-K lists "large enterprise software companies, government contractors, and system integrators" among its competitors2; the ruling helps the first group as much as Palantir.

So far the rivals have not shown up in the numbers. US government revenue grew 55% in 20253 and 90% in the second quarter of 20264.

High margins invite rivals. The government segment's contribution margin reached 71% in the second quarter of 20265, a level that tells every software company and contractor how profitable defence software can be. The opening Palantir won in court is now also an advertisement.

The test is whether Palantir keeps winning the consolidated awards. A large defence programme that chooses another vendor's commercial product under the rule Palantir created would show the opening now belongs to everyone.
