Netflix (NFLX) — threat to the moat
Netflix's $1 billion of annual production subsidies depends on governments that can change the terms whenever they like.
Subsidies are policy, and policy moves. The same governments offering tax credits to attract production can reduce them, cap them or pair them with obligations. Netflix's 10-K already lists "investment obligations, levies, and content catalog quotas" among its regulatory risks1.
The exposure is worth about $1 billion a year2, roughly 7.5% of 2025 operating income3. Losing a large share of it would not end the business, but it would take a visible slice off the margin.
Netflix's ability to move production is its defence, but moving a production costs money and time.
Netflix also carries $566 million of gross unrecognized tax benefits4, positions tax authorities could challenge. Incentives and tax positions together are a meaningful slice of earnings that depends on the goodwill of governments.
The line to watch is the incentive total against produced amortization. About 13% in 20255; a fall below 10% would mean the subsidy is shrinking faster than Netflix can chase it.
