At least nine generic makers are already in court over AbbVie's two migraine drugs.
The competitors AbbVie cannot out-invent are the generic makers, who wait for a patent to end or try to end it early. AbbVie is litigating patent challenges on its migraine drugs: suits against Aurobindo, Zydus and Hetero over Ubrelvy were filed in March 2024, and suits against Apotex, Macleods, Dr. Reddy's, MSN, Hetero and Micro Labs over Qulipta from December 20251.
The drugs at stake are growing. Ubrelvy sold $1,271 million and Qulipta $1,036 million in 20252. Early generic entry would take them the way biosimilars took Humira.
AbbVie's settlement practice is the other side of this contest. For Rinvoq it agreed a date, April 2037, before which no generic is expected in the United States3. Settlements trade uncertainty for a known end.
The generic makers are patient and numerous. Their suits are the clearest sign of which AbbVie drugs are considered valuable enough to attack.
Litigation is a normal part of a drug's life in America. Under the rules for generic approval, a challenge to a patent is filed years before the patent expires, and most end in settlements with dated entry. The migraine suits started in March 2024 for Ubrelvy and December 2025 for Qulipta4, which suggests dated settlements will follow in the next few years.
AbbVie's own record includes settling such suits on favourable terms. The Rinvoq settlement pushed generic entry to April 20375, years beyond the composition patent. A similar outcome for the migraine drugs would protect a franchise that sold $2,307 million in 202567.
The outcome of the migraine suits is the thing to watch. A ruling or settlement that allows entry before the late 2030s would shorten the life of AbbVie's second-growth neuroscience franchise.
