A Colorado board wants ENBREL priced well below list from 2027, while Sandoz sues Amgen for keeping its copy off the market.

Federal price setting is not the only kind. Colorado's prescription drug affordability board set an upper payment limit for ENBREL that the 10-K describes as substantially lower than the wholesale acquisition cost of ENBREL, effective no earlier than January 1, 20271. Washington State selected ENBREL for an affordability review in July 20252.

Four kinds of price pressure on one drug.

A state limit matters more than its size suggests. It shows that an old biologic's price can be capped without an act of Congress, and it is aimed at a drug that sells almost entirely in the United States: in the second quarter of 2026, $574 million of ENBREL's $580 million was American3.

ENBREL is also defending itself in court on the other side. A class action by CareFirst, filed in August 2024, and an April 2025 suit by Sandoz claim violations of the antitrust laws and tortious interference related to Amgen's patent rights to ENBREL4. Sandoz is a biosimilar maker; its claim is that Amgen's patents kept a copy off the American market.

The combination is awkward. Regulators say ENBREL costs too much, and a would-be competitor says Amgen kept prices high by stopping its entry. If either argument wins, the drug's remaining value falls.

What would confirm the threat is a second state adopting a limit, or a ruling for Sandoz. Either would bring the effective end of ENBREL's pricing forward from the 2028 and 2029 patent dates to now, and the first-quarter 2026 fall of 37%5 is a preview of the numbers that would follow.
