Keytruda's royalty ends in time to flatter two years of margins, and then the patents start to expire.

The end of the Keytruda royalty looks like good news, and for two years it is. The 2.5% royalty terminates after 20261, worth roughly $792 million a year at 2025 sales2. But the American compound patent expires in 2028 and biosimilar competition could begin in December 20283.

The saving is about $0.8 billion a year.

So the saving arrives on a shrinking base. Merck itself expects that sales of Keytruda will be materially negatively impacted by biosimilar competition between 2028 and 20294, and that a government-set American price will take effect on 1 January 20295.

The danger is in how the saving is read. Two years of higher margins in 2027 and 2028 could look like a structural improvement when it is a contract running out beside a patent running out.

The ending royalty is one of several good years clustered before 2029. The Gardasil royalty of 7% on American sales also expires in December 20286, and Merck's savings programme is due to deliver $3.0 billion a year by the end of 20277. Each is real; together they make the years just before the patent dates look stronger than the business that will exist after them.

The number to judge it by is Keytruda's American sales, $18,829 million in 20258. A 2027 margin gain accompanied by flat or falling American sales would confirm that the royalty merely cushioned the start of the decline.
