Merck is moving Keytruda patients to an injection whose American patent runs to 2043, fifteen years past the original's.
Keytruda Qlex is Merck's answer to its own patent calendar. It is the subcutaneous form of the same antibody, approved by the FDA in September 20251 and by the European Commission in November 20252. Its American patent is listed as expiring in 2043, against 2028 for the original compound, while its European protection runs to 2031 with an application pending to 20403.
The switch has begun quickly. Qlex sold $40 million in 20254 and $463 million in the second quarter of 20265, about 5.5% of the $8,366 million franchise that quarter6. Patients who move to the injection before December 2028 are patients a biosimilar of the intravenous drug cannot simply substitute.
The logic is familiar in this industry: move the installed base to a newer, better-protected form before the old one loses exclusivity. It works only if doctors and payers see a genuine benefit, such as shorter chair time, and if the newer patents hold.
That second condition is not settled. Halozyme alleges that its enzyme patents cover an ingredient of the injection, and a German court has barred sales there pending appeal7, as the threat below explains.
The competitive logic has a mirror image. Bristol Myers Squibb launched a subcutaneous form of its rival drug, Opdivo Qvantig, which sold $238 million in 20258. Both leaders of the PD-1 class are trying to move patients to injections before their original molecules lose protection, and Merck's is the larger conversion so far.
Qlex is Merck's main hedge against 2028, and it is still small. Its share of the Keytruda franchise is the figure to follow: rising well above a quarter before the end of 2028 would mean the conversion is real; stalling near a tenth would mean most patients will meet the biosimilars on the old formulation.
