Text (TXT) — threat to the moat
An eighth of Text's earnings rests on a preference the Polish parliament granted and could revisit.
Text's earnings quality rests partly on a preference granted by legislation, and legislation is revisable.
The company applies a 5% rate to income from qualifying intellectual property rights alongside the standard 19% on other income, producing an effective charge of roughly 8% on pre-tax profit of 126,7 million złoty1. Restated at the ordinary Polish corporate rate, net profit would fall by something close to 14 million złoty — a tenth of what shareholders received as dividends last year2.
Nothing about the current position suggests instability. The IP Box has been in place for years, Text has applied it consistently, and the deferred component has been calculated at an expected rate near 7% in both of the last two years3.
The risk is generic rather than specific, and it has recent precedent close to home: Polish banks saw corporate income tax raised from 19% to 30% by an amendment signed in November 2025 and effective from the following January, with the rate scheduled to step down again over the following two years. A government that needs revenue looks at profitable, immobile, domestically-taxed sectors.
Text is more mobile than a bank — its revenue is already booked through a United States subsidiary4 — but its people, and therefore the qualifying intellectual property, are in Wroclaw5.
There is no number that forecasts this. The observable one is the effective rate in each year's accounts, which has crept from 6,89% to 7,95% over two years6 without any legislative change at all.
