The foundational architecture is public domain. What Intuitive still owns is everything it has added since, which is a different and shallower kind of protection.

Intuitive launched its first da Vinci in 1999 and obtained FDA clearance for general laparoscopic surgery in 20001. The patents behind that generation — the console, the wristed instrument, the master-slave translation of hand movement into instrument movement — were filed in the mid-1990s and have expired. That is not a failure; it is how the system works, and Intuitive acknowledges it directly2.

The consequence is visible in the competition list. Fourteen companies, including two of the largest device manufacturers on earth and at least six Chinese firms, are named as having introduced robotic products or stated an intent to3. That list did not exist a decade ago and it is not short because the technology is impossible; it is because the surrounding requirements — clearances, evidence, training, instruments, service — take years.

What Intuitive still holds is the accumulated later work, and it is significant: force feedback in da Vinci 5, SureForm stapling with SmartFire technology taking more than 1,000 measurements per second, the E-200 generator, the Ion shape-sensing catheter4. Each of those is a reason a surgeon prefers this platform, and each is protected for a while.

The test is whether the refinement rate holds. R&D was 13.0% of revenue in 20255, and the fifth-generation system arrived twenty-five years after the first. A competitor does not need to catch up with da Vinci 5; it needs to reach the point where the marginal advantage no longer justifies the switching cost.
