A very large patent estate protecting products cleared on the lowest regulatory pathway there is.
Intuitive owned more than 5,600 patents granted and still in force and more than 2,500 pending worldwide at the end of 20251. It is one of the largest estates in medical devices and it took twenty-seven years to build.
It is also the facet of the moat that is most obviously finite, and Intuitive says so in its own words: "Patents have finite terms. The expiration of a patent ends the exclusive rights accorded by the patent for the invention claimed." The foundational patents on wristed instruments and the master-slave console architecture date from the 1990s and are long expired, which is precisely why fourteen companies now appear in the competition disclosure.
The regulatory position is weaker than the estate suggests. Intuitive's products are Class II medical devices cleared under section 510(k) of the Federal Food, Drug, and Cosmetic Act, which requires a manufacturer to demonstrate that its device is "substantially equivalent" to a legally marketed predicate2. That is not the approval regime that protects a drug; it is a pathway explicitly designed to let comparable products onto the market. Every rival that clears it does so partly by pointing at a da Vinci.
What the patents and the twenty-seven years actually buy is harder to name and more durable: the accumulated engineering of instrument wrists, cable drives, energy delivery, stapling, imaging and control software, plus the clinical evidence base and the regulatory clearances for specific procedures in specific countries — a list Intuitive has been extending one indication at a time for two decades. A competitor with a working robot still has to obtain clearance for each procedure in each market, and then generate the evidence that persuades a surgeon to use it.
The current expression of it is da Vinci 5, cleared by the FDA in March 2024 for all specialties indicated for da Vinci Xi except cardiac and pediatric, with more than 10,000 times the computing power of its predecessor and force-feedback instruments that measure the force applied to tissue3. The installed base reached 1,231 systems by the end of 2025 and 870 of the year's 1,721 placements were da Vinci 54.
This facet is rated below the first two and marked narrowing because both of its components are eroding at the edges: patents expire on a schedule, and the 510(k) route is open to anyone who can show equivalence. What is not eroding is the twenty-seven-year head start in evidence and indications.
Grade it on the count of named competitors in the 10-K's competition disclosure — fourteen today5, eight of them Chinese or Asian. The list has been getting longer, which is what a moat made of accumulated engineering looks like when the engineering stops being scarce.
More than 5,600 patents and counting, against a regulatory pathway that let two of the largest device companies in the world arrive within eight months of each other. Both halves are exactly where they were.
A very large estate protecting refinements of an idea whose foundational patents have expired. Which is why the number that matters more is the next one: fourteen named competitors.
