A Constitution the Company PublishesNarrow moat

Anthropic (ANT) — moat facet

Anthropic publishes the values it trains Claude on and says that transparency wins enterprise deals, without quantifying a single one of them.

Anthropic trains its models in accordance with the constitution for Claude, "which we make publicly available"1. The document "describes our vision for how an AI model should be and how it should behave, which is used directly in the model training process"2, and it orients Claude around four priorities: "Be Broadly Safe", "Be Broadly Ethical", "Be Compliant with our Guidelines" and "Be Genuinely Helpful"3.

The four priorities in Claude constitutionPriority 1, Be Broadly Safeavoid irreversible actions and support human oversight of AI behaviorPriority 2, Be Broadly Ethicalmaintain honesty and sound moral judgment, avoid harmful actsPriority 3, Be Compliant with our Guidelinesoperational standards and absolute prohibitions on certain harmsPriority 4, Be Genuinely Helpfulsubstantive, expert-level assistance that creates real valueAnthropic Form S-1, Claude Constitution section
A published ranking of what the model should put first.

The company makes two claims for it, and they are different in kind. The technical one is that training Claude on "high-quality constitutional documents combined with fictional stories portraying an aligned AI" contributes to reducing its misalignment rate4. The commercial one is that the constitution "has also proven commercially valuable: transparently laying out the values we intend Claude to hold increases customer trust"5.

The second claim is the one that belongs in a moat. Anthropic says "rigorous safeguards and predictable model behavior have become decisive criteria when selecting an AI partner"6, which would make published values a procurement advantage rather than a cost. The customer base is consistent with it: more than 1,900 customers above $1 million of trailing revenue at 30 September 20267, including nine of the ten largest pharmaceutical companies8.

Neither claim is quantified anywhere. There is no disclosed win rate, no deal attributed to the constitution and no measure of the misalignment rate it is said to reduce.

The ordering of the four priorities is itself a statement, and a commercial one. Being broadly safe comes first and being genuinely helpful comes last9, which tells a buyer that where the two conflict the model is trained to refuse. Anthropic argues this is what enterprises want, and the same section claims that safeguards and predictable behaviour are now decisive in choosing an AI partner10.

It gives away the plumbing too. Anthropic donated the Model Context Protocol, the interface through which Claude reaches other systems, to the Linux Foundation in December 202511. The logic is the same as publishing the constitution: a standard everyone adopts is worth more as a standard than as a secret. The cost is the same as well, since a protocol under foundation governance can be implemented by any rival that wants Anthropic's integrations without Anthropic's models.

The count of accounts above $1 million is the nearest available test. If published values are worth what the company says, that tier should keep filling faster than the total customer count, because large regulated buyers are the ones who read the document. A stall there while the long tail grows would suggest the constitution is a conviction rather than a differentiator.

Moat trajectory: Holding steady

The constitution is published and revisable; its commercial effect is unquantified.

The number that tests this moat
Reported
Customers above $1 million of trailing revenue
More than 1,900 (30 September 2026)

The tier where published safeguards would show up as deals; a stall here while the tail grows would mean they are not a differentiator.
