The Patent TollWide moat

Qualcomm (QCOM) — moat facet

Thirteen percent of revenue, a quarter of the profit, and it does not have to win a single design to collect it.

A royalty on the phone, not on the part — that single design decision is why Qualcomm has a moat rather than a good product line.

The toll is an eighth of the revenue and a quarter of the profit.

QTL grants licences to portions of a patent portfolio that includes claims essential to the manufacture and sale of wireless products implementing the mobile standards.1 The licensee is the handset maker. The royalty is a percentage of the handset's price. Whether the phone contains a Qualcomm modem, a MediaTek modem, a Samsung modem or one the manufacturer built itself, the payment is the same, because what is being licensed is the right to make a device that works on a network at all.

The economics are unlike anything else in this company. In fiscal 2025 QTL generated $5,582 million of revenue against $1,539 million of total costs and expenses, for pre-tax profit of $4,043 million — a 72% margin, essentially unchanged for three years.2 QCT, the chip business, turned $38,367 million of revenue into $11,670 million of profit at 30%. Thirteen percent of Qualcomm's revenue produces about a quarter of its pre-tax profit, and it does so with no factories, no inventory and, in the ordinary course, no sales cycle.

The portfolio's strength is that it was accumulated over four decades of contributing to the standards themselves, which is not a position that can be assembled by acquisition. The weakness is that every part of it — the essentiality of the patents, the royalty base, the rate, the term — is a legal question with a counterparty who has lawyers.

The whole thing renews. Licences have terms, and during fiscal 2025 Qualcomm executed final agreements for new long-term arrangements.3 Each renewal is a negotiation with a customer that has spent the interval getting larger.

Moat trajectory: Holding steady

QTL revenue was $5,306m, $5,572m and $5,582m across three fiscal years and the 72% margin did not move. Nothing about the patent position has strengthened or weakened; it simply continues, which is what a legal entitlement does between disputes.

The number that tests this moat
Reported
QTL pre-tax margin
72% — against 30% at the chip business

QTL turned $5,582M of licensing revenue into $4,043M of pre-tax profit in fiscal 2025, on total costs and expenses of $1,539M. QCT turned $38,367M into $11,670M. Thirteen percent of revenue produces roughly a quarter of the profit, from a business that collects on handsets rather than on parts. Watch the margin: it has been 72% for three years, and any move down would mean the rate or the base has been renegotiated.
